EFFECTIVE DATE OF THE RENTAL CONTRACT
The rental contract begins on the day indicated in the booking. By DAY we mean a period of 24 hours or fraction, starting from the moment of delivery of the vehicle to the customer.

VEHICLE DELIVERY
The user/customer must present the following original documents at pick up:

• A driver’s licence valid in Italy: for European drivers the driving licence must have been held for at least one year.
• A driver’s licence, plus an International Driving Permit for non EU/EFTA drivers.
• A valid ID card or passport.
• A valid credit card in the designated or primary driver’s name (please see affiliated cards below) for the payment.
• A valid credit card in the designated or primary driver’s name (please see affiliated cards below) for the deposit: we will ask you to leave us with some security for any additional charges that may arise during your use of the Vehicle over the Hire Period. This security is in the form of a financial deposit and the amount for this will have been specified in your confirmation. Provided there are no extra charges, damages and/or fees to pay when you return the Vehicle to us at the end of the Hire Period and it has been checked-in then the deposit amount will be released in full.

AUTHORIZED DRIVERS
The Customer who signs the rental contract and other drivers indicated in the contract are the only authorized drivers.

LIMITATIONS FOR THE CUSTOMER
The Customer is strictly prohibited to:

• • Allow or permit other drivers who have not been registered in the Rental Contract to drive the vehicle
  • Drive the vehicle in states where the Insurance policy is not valid
  • Assign or sublease to third parties the rented vehicle
  • Drive the rented vehicle in races or speed competitions on public or private roads, or circuits.
  • Drive the vehicle  under the influence of alcohol, hallucinatory drugs, narcotics, barbiturates, other illegal drugs or any other substance (whether legal or illegal) that is liable to impair ones driving ability.

DRIVING LIMITATIONS
In order to rent and drive a 7-seater vehicle the Drivers must be at least 21 years old and 23 years old to drive a 9-seater and the licence must have been held for at least two years.

RELATING TO FINES AND PENALTIES
The Customer is responsible for and will pay all charges arising from: o any congestion or parking charges (or failure to pay them); o a breach of any parking restrictions or a road traffic offence or any other offence or infringement involving the Vehicle such as (but not limited to) lane infringement, tunnel, turning and bus lane charges including the costs from the Vehicle being clamped, seized or towed away and any other charges/costs (or failure to pay them) levied by a relevant organisation or issuing authority. The driver is and will remain primarily liable for such charges and you consent to us notifying such organisations of  personal details to effect a transfer of liability. If we are required to deal with such correspondence we will charge your credit/debit card for our Third Party Administration Charge.

RELATING TO DAMAGES, ACCIDENTS OR MECHANICAL BREAKDOWN
Our vehicles are delivered with a full tank of fuel, RCA insurance and driver accident insurance, Kasko + fire and theft insurance which covers any traffic damage suffered by the vehicle regardless of the driver’s responsibility. The Customer is obliged to return the rented vehicle and its keys, accessories, or documentation to us in the same condition as they were at check out, with full tank.  If the vehicle breaks down or is involved in an accident/incident in mainland Italy during the Hire Period we will, as soon as possible, recover and repair the Vehicle so that it is rendered functional.

In case any damage or breakdown takes place during the rental period, the driver is asked to report immediately to us; ABC will provide necessary help and assistance.

FORCE MAJEURE
ABC RENT shall not be held responsible for any breach of the signed rental contract, such as delay of performance or no performance, if such a delay or failure to perform come as a result of circumstances or causes beyond our control, and to be considered as force majeure events. Such circumstances and events may include, but not limited to, any natural disaster, flood, drought, earthquake, epidemics and pandemics, terrorist attaks, civil riots, wars, armed conflicts, the imposition of sanctions or embargos, changing in local, national or international laws.

APPLICABLE LAW AND COMPETENT COURT
Under these terms and conditions of use, should a court resolution become necessary, the Laws of Italy will be applicable and the Court of Siena will be competent.
